Another Permanent Residence Permit Issued!

Our client and his family initially applied for a permanent residence permit for the first time and received a negative decision from the Finnish Immigration Service. They immediately sought assistance from our office and we appealed the case to the Administrative Court and applied for a residence permit based on family ties simultaneously. 

The new application for a residence permit was approved, granting them a one-year permit. However, the authorities were still evaluating whether they had sufficient means of support to be eligible for a permanent residence permit. Due to our appeal to the Administrative Court, the court sent the case back to the Finnish Immigration Service for re-evaluation. Typically, if the decision is positive for the applicant and it is the same type of residence permit, the Administrative Court automatically cancels the appeal. However, since the family’s application was based on different grounds (permanent and family ties) than on a permanent residence permit, the appeal was not automatically cancelled and remained valid. 

Therefore, when the case was returned to the Finnish Immigration Service, it had to be considered in light of the current income situation. Eventually, the family received a positive decision for the permanent residence permit they originally applied for. In summary, we provided them with a route to obtain a one-year residence permit while waiting for the administrative court’s decision, and ultimately, we successfully assisted them in obtaining the permanent residence permit they sought in the first place.
