Another overturned decision from the Administrative Court!

Our client approached our office last year seeking assistance appealing a negative decision he received from Finnish Immigration Service on his residence permit application based on entrepreneurial grounds. 

The ELY-Keskus and Finnish Immigration Service contended that our client’s companies were not profitable, leading to doubts about the stability of his livelihood. Additionally, they also raised concerns about our client’s extensive travel abroad during the duration of his previous residence permit.

Recognizing that the Finnish Immigration Service had not fully considered the case on its entirety, we decided to appeal the decision to the Administrative Court. Upon reviewing the case, the Administrative Court overturned the decision due to ELY-Keskus issuing a partially negative decision solely based on the challenging circumstances of the year 2020 during the pandemic, which affected all businesses’ profitability. Additionally, the Finnish Immigration Service failed to take into account that our client was overseas promoting his businesses when the pandemic began and was unable to return to Finland until the borders reopened.
