And Another Positive Decision!

This time our client came to our office with an additional information request. The TE- Office issued the negative decision. The reasons for the decision were clear due to the company’s bad financial situation, meaning that the company could not employ any workers. However, by the time our client reached us, the financial situation of the company had a radical improvement, which allowed us to return the case to the TE office for revaluation. We proceeded to draft the arguments for the response to the additional information decision.


Although the Finnish Immigration Office has received the additional information, they made a decision shortly after without taking into consideration the additional information received. In this case, we had to cancel the decision of the Finnish Immigration Service due to their administrative mistake. We returned the case to for revaluation based on the Administrative law. The application was in process again, and during the process, a new additional information request was sent, to which we responded on time.

 
Unfortunately, the same issue happened again, where the decision maker issued a negative decision without taking into account the additional information response received. Based on the same article of the Administrative law, we have cancelled the decision and returned the case for the revaluation one more time.


This time, after taking everything into account the decision-maker decided to issue a one-year residence permit based on employment grounds to our client.


It has been a battle! We don’t believe, that we have come victorious, but that both parties worked to the best of our abilities. The Finnish Immigration Service issued our client a residence permit, that he deserved and our client received a residence permit that he was expecting.


Thankfully, our client didn’t have to go through the administrative process such as appealing the case to the Administrative Court to receive the residence permit, as it is a very time-consuming process.
We are happy that our client trusted us in this case. We wish other clients facing the same or similar situation – of having already issues with negative decisions and needing to appeal the case to the Administrative Court and those who never had issues but started the process from the beginning – to contact us with expectations to receive similar results.
