There are cases where the immigration process becomes unpredictable, and individuals who have done everything correctly find themselves suddenly at risk of losing their right to stay in Finland. Our client experienced exactly this when the Finnish Immigration Service issued an additional information request related to her partner´s study-based residence permit. Although she had complied with the conditions tied to her stay, the difficulties faced by our client’s partner placed their future in Finland under significant strain. The response we submitted clearly explains the reasons behind these challenges and the impact they had on the progression of her partner’s studies.
Our client and her partner had relocated to Finland with a genuine intention to study, integrate and establish a stable life together. Her partner’s inability to complete the practical portion of her programme was the result of a serious medical condition, supported by both Finnish and foreign medical documentation. The physical demands of the internship, combined with the lack of accommodation from the educational institution, made it impossible for her to continue without risking long-term harm. Despite their responsibility, transparency and financial independence, the couple suddenly faced the possibility that one negative decision could separate them.
To ensure that our client’s stay would not be interrupted, we submitted a new residence permit application on her behalf based on employment grounds. By doing so, we protected her from the risk of falling out of status, even if the study-based application encountered obstacles. This strategic change of grounds was essential. It allowed her to maintain lawful residence while her partner’s case remained under assessment, ensuring that neither of them would lose their rights because of circumstances entirely outside their control.
While handling the matter, we emphasised the significance of the couple’s shared life in Finland and the principles of proportionality that must guide all decisions related to residence permits. Our client has showed consistent compliance with Finnish law, maintained lawful employment and contributed to society. Her partner has also acted in good faith throughout their stay, and the couple has built a genuine life together. Any interruption to their residence would have caused unnecessary harm and disrupted the stability they have created through their independent efforts.
The careful approach taken proved decisive. The Finnish Immigration Service granted our client a new residence permit based on employment, valid from 19 November 2025 until 16 October 2026. The permit was issued under the provisions for employed persons and confirms her right to work in her professional field as well as in labour shortage sectors, as stated directly in the decision.
This case emphasizes the importance of timely action, clear presentation of facts and a thoughtful strategy that protects both the rights and the future of those who place their trust in us.
