And Another Challenging Case!

This time our client visited our office after receiving a negative decision from the Finnish Immigration Service regarding the renewal of his residence permit application based on employment grounds because he was caught driving under the influence.

Driving under the influence is considered a criminal violation of traffic. We took the case because we didn’t see him as a person who is driving under the influence on daily basis but as a person who made a mistake. 

We appealed the matter to the administrative court, luckily the point of view of the administrative court aligned with our perspective, especially after providing them with the graduation certificate to show that our client is not a public danger and it was only a one-time situation and he is focusing on his future, he is taking steps to improve himself and he deserved a second chance.

The Administrative Court decided to grant him that chance and returned the case to the Finnish Immigration Service for re-evaluation.

Usually, when it is a renewal of a residence permit and the case returns to the Finnish Immigration Service the person gets four- year residence permit, however in this case our client got a one-year residence permit because the authority would like to monitor him for the next year.

We are so happy that a second chance was given to our client, we wish to raise awareness that driving under the influence is a reason for anyone to receive a negative decision at any stage of their residence permit application. It is not guaranteed that everybody will get a second chance but we are happy that our client got one.
