From Cancellation to Four Years of Stability

Our client contacted us after the Finnish Immigration Service cancelled their family-based residence permit and ordered their removal from Finland. The decision followed changes in the residence status of the family member on whom the permit had originally depended.

The matter could not be assessed only by looking at the original basis of the permit. By the time the decision was issued, our client had already built an established life in Finland through family, employment and responsibility for the household. The family also had a young child whose everyday life and development were connected to Finland.

We appealed the decision because the individual circumstances had not been given sufficient weight. The Aliens Act requires the authorities to consider proportionality, the protection of family life and the best interests of the child. A temporary change in one family member’s circumstances should not automatically lead to the cancellation of the entire family’s residence rights without a careful assessment of the situation as a whole.

During the process, our client’s employment became particularly important. They had secured stable, full-time work and were independently supporting the family. This showed that their position in Finland was no longer based only on the earlier family-related circumstances. Their work, income and established daily life created a strong and concrete basis for continued residence.

We ensured that the Finnish Immigration Service received a clear and updated picture of the client’s current situation. The case was no longer about whether an earlier circumstance had changed, but whether the client now met the legal requirements for residence on the basis of their own position in Finland.

The result was positive. On 15 July 2026, our client received a continuous A-type residence permit based on employment, valid for four years until 15 July 2030. The permit allows them to continue working in their professional field and in the labour shortage sectors defined by government decree.

A case that began with the cancellation of a residence permit and an order to leave Finland ended with long-term stability. Our client can now continue working, supporting their family and building their future in Finland without the uncertainty created by the earlier decision.

This case shows why a person’s present circumstances must always be examined carefully. Immigration cases develop, family situations change, and new legal grounds may arise. The outcome depends on whether the case presented to the authority reflects the person’s actual life at the moment the decision is made.
