Another Positive Decision!
Even though the decision is positive, it might not always meet our expectations. In the current case, we are still advocating for the applicant’s uninterrupted stay in Finland to ensure a smooth and legally consistent pathway toward applying for a permanent residence permit in the future.
The applicant initially submitted an extended residence permit application on employment grounds. As circumstances changed—particularly the development of stable and ongoing family life in Finland—the grounds were rightfully updated to reflect the more appropriate basis: family ties.
During this change of grounds, the applicant maintained lawful residence by submitting the family-based application while the previous one was still pending. Despite this, the Finnish Immigration Service has raised the possibility of a “permit gap,” which, if accepted, could severely impact the applicant’s future eligibility for a permanent residence permit.
This so-called gap is not based on law but rather on internal guidelines, and its application in this case is both legally questionable and deeply unfair. The applicant has always acted within the law, maintained sufficient means of support, and remained integrated in Finnish society. It would be unreasonable and disproportionate to penalize this individual over a procedural technicality that contradicts the very principles of legal continuity and fair administrative practice.
We continue to fight not just for a permit, but for uninterrupted legal recognition—so that the applicant’s future in Finland is not compromised by an unjust interpretation of rules that were meant to protect, not punish.
